General Conditions of Sale and Use of our services

These conditions govern the sale of any service presented under the brand name aporo sport represented by Nicolas Chambras, individual entrepreneur, resident at 3 rue du Boële, 41360 Lunay - Registered with the Chamber of Trades and Crafts of Loir et Cher, SIRET number 414 236 406 00040.

The parties agree that their relations will be exclusively governed by this contract, to the exclusion of any other condition. They are concluded intuitu personae and cannot therefore be the subject of any assignment, of any nature whatsoever.

Any duly validated order implies total and unreserved acceptance of these general conditions of sale and, possibly, of the special or specific conditions for one or more products or services.

1. Object

These conditions aim to define the reciprocal obligations of the parties as well as the different stages of the ordering process.

2. Articles and products

aporo sport is a registered trademark of Lois and Nicolas Chambras which aims to offer for sale graphic design services for clothing items and accessories related to sport.

The services or products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, Nicolas Chambras cannot be held liable. The photographs illustrating the services in support of the text do not enter into the contractual field.

3. Principle for balloon design

We offer 4 original designs with the possibility of being personalized in the colors of the club or sports association.

3.1 Option 1: non-personalized ball

In this case, the balloon remains in the original colors of the design and retains all the distinctive elements of the basic decor on each of the panels. The "Standard" rate applies.

3.2 Option 2: aporo design with club personalization on two panels

The design is in the colors of the club and two panels are reserved for it. The colors of the distinctive aporo elements adapt to the colors of the club.

3.2.1 The club uses the same element on both of its backboards; the “*” rate applies.

3.2.2 The club uses one sign for its image and one sign for sponsor placement; the “**” rate applies.

3.3 Option 3: aporo design with customization on 3 panels

The design is in the colors of the club and three panels are reserved for it. The colors of the distinctive aporo elements adapt to the colors of the club.

3.3.1 The club uses 2 panels for the same image and uses the sponsor panel for the third panel (or vice versa); the “**” rate applies.

3.3.2 The club uses 1 panel for its image and reserves the two panels for two different sponsors; additional costs (per balloon size) at “**” rate apply. Contact us for a specific quote.

3.4 Option 4: the club wants an original bespoke design other than the basic aporo designs

3.4.1 We can take charge of the creation and technical production of the decor; the club must provide us with a brief. A specific estimate will be established for the creation of the decor.

3.4.2 The club has a service provider to create its decor; we provide the specifications to follow for the creation and technical realization. The quote will be based on the design provided; any intervention on our part linked to a misinterpretation of the specifications will be invoiced to the club.

Aporo prices for personalized balloons are given for two colors, black is free and acts as the third color. The club must ensure that its partners agree on the principle of working only with the colors of the club. It is quite possible to work with more colors and each partner is entitled to want to use their own colors. Please contact us for a precise calculation if you require additional colours.

4. Principle for the design of kits and clothing

We work on the basis of a personalized design according to a brief given by the client.

4.1 The club has a service provider; we work according to his specifications and give him the technical work files.

4.2 The club has no service provider; we put him in contact with a specialized service provider with whom we are used to working.

5. Prices of products and services, delivery

The prices are presented in euros and precisely defined by estimate. VAT is not applicable on the services offered. If the development of the company involves the application of VAT, it will be French VAT at the rate in force for the products and services concerned and the customer will be informed beforehand. If the VAT rate were to be modified, these changes could be passed on to the price of the items without the customer being informed beforehand. Delivery is made within 6 to 14 weeks from receipt of payment. the command ; nevertheless, any fortuitous event or force majeure which would delay the delivery beyond the will and the diligence of aporo sport cannot be blamed on it. The prices indicated relate to the finished product and do not take delivery costs into account. The products can be collected by appointment, 7 days a week at 3 rue du Boële - 41360 Lunay The products can be delivered to an address specified during the ordered. The number of packages and their weight being variable, an addendum to the estimate will be provided to the customer to confirm the cost of delivery. This addendum must be validated by the customer and its full payment triggers the delivery.

6. Order

The customer interested in an article follows the following process in order to establish his order.

He informs us of his needs via the aporosport.fr website or by email at bonjour@aporosport.fr or during an appointment made by telephone. After having received the estimate meeting the requested criteria and after having checked the specificities of his order (color, quantity, price, etc.), the customer validates his choice of the product(s) selected by establishing an order form containing all the characteristics of his order or by validating the quote "good for agreement” dated and signed. He must then provide his contact details with the following mandatory information: title, surname, first name, full delivery address, e-mail and telephone number. An invoice will then be presented to him in return for payment upon receipt.

7. Terms of payment

For any first order, the terms of payment are as follows: 100% on order. For any “tailor-made” graphic creation: the graphic creation is independent of the price of the production of the products and is the subject of a separate estimate. The terms of payment are as follows: 50% on order and 50% after validation of the “Good to print”. For the production of standard “aporo sport” brand products (without “club” personalization), the terms are 50% on order, 50% on delivery. The full payment validates the delivery. For the production of finished "tailor-made" products (with "club" personalization), the payment conditions are as follows: 100% on order. The full payment validates the order and the delivery.

8. Terms of payment

The customer has the option of paying by check, from a French banking establishment payable in France, or by bank transfer to the account indicated on the invoice.

Whether the payment is made by check or bank transfer, the order is definitively and irrevocably effective only when the amount of the invoice is credited to the bank account indicated on it. This validation is worth sale and irrevocably commits the parties.

In all cases, whatever the method of payment chosen by the customer, aporo sport will acknowledge receipt of the order as soon as it is validated by e-mail or by any other means at its convenience.

9. Return of goods:

The customer has 14 days to return a product in new condition at his own expense for “standard” aporo sport products; he may change the product or request a refund. Shipping costs are not refunded. Personalized products at the customer's request are neither returned nor exchanged and are not subject to any refund. In the event of a product exchange, if the new order is for a higher amount, the customer must attach the payment of the balance to the exchange request. Conversely, if the amount of the exchange is less than the initial amount, the user will receive upon receipt of the request either a credit or a refund of the difference. To make an exchange on a "standard" aporo sport product, the customer must return the goods at his own expense to Nicolas Chambras - aporo sport - 3, rue du Boële - 41360 Lunay. To be eligible for a return, the product must be new, unworn or used and in its original packaging. The return costs are the responsibility of the customer. The return of the item(s) within this period must imperatively be accompanied by a photocopy of the invoice indicating the desired product in replacement by email to bonjour@aporosport.fr or by post. at the following address: Nicolas Chambras - aporo sport - 3, rue du Boële - 41360 Lunay. The seller will refuse all damaged items that have not been the subject of comments or express reservations by the customer upon delivery.

10. Intellectual property and competition

All the elements of the aporo sport site and the graphic creations produced as part of its activity, whether visual or sound, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of Nicolas Chambras. The user who has a personal website and who wishes to place, for personal use, on his site a simple link directly to the aporo sport site, must first seek the authorization of Nicolas Chambras. The visuals generated during the creation process are the property of Nicolas Chambras; their use must imperatively be the subject of an authorization request for any medium whatsoever, paper, multimedia or any present and future technology. will be the subject of a transfer of copyright to the customer. All sketches, research, tests and tracks not validated remain the entire property of Nicolas Chambras. The client is entirely responsible for the content provided for placement on the medium of his choice. He must ensure the legality of their use and must have fulfilled the obligations relating to the rules of image rights, copyrights, etc. The seller undertakes to respect the rules of confidentiality relating to documents, information and images made available to it by the client for the performance of the work and guaranteed their non-disclosure to third parties, including within its company / organization, unless otherwise instructed by it in writing.
